A friend who has been in HR for over a decade was called into their boss's office last week and asked one question:员工自己签了放弃社保的协议,应该查不到吧?”
她的直觉是对的。Starting 11/1, the "National Standard for Tax Administrative Penalty Discretion (2026 Edition)" officially takes effect, marking the first time that social security payment violations are included in the unified national tax administrative penalty discretion system. In the past, practices such as "employees voluntarily waive coverage and the company provides a cash supplement" were legally untenable; now, they carry a specific monetary cost.
If an employer fails to pay social security contributions within the deadline after being ordered to do so, they will be fined between one and three times the amount owed. Penalties are categorized into three tiers—general, serious, and severe—based on the unpaid amount and its proportion of the total required contribution. Specifically: if the unpaid proportion is less than 30% and the amount falls between ¥50 million and ¥500 million, a penalty multiplier of 1 applies. As both the proportion and amount increase, the penalty multiplier escalates accordingly. For example, if a company owes ¥600 million, representing 35% of the total due, it triggers the highest tier, resulting in a maximum fine of ¥1800 million plus late fees of 0.05% per day. This goes far beyond simply making up the payment.
After social security contributions were transferred to tax authorities, the tax bureau now holds three key data streams for each enterprise: individual income tax declaration bases, corporate income tax wage and salary expenses, and social security contribution bases. With Golden Tax Phase IV's cross-system comparison capabilities, logical discrepancies between wages, individual income tax, and social security are no longer detected through manual account reconciliation but are automatically flagged by the system. In other words, the risk of underpaying social security has shifted from being exposed only when reported to being uncovered by automated data matching.
Immediately investigate whether any "voluntary waiver of social security" agreements or cash compensation arrangements exist; such agreements have no legal defense against administrative penalties.第二,Reconcile differences between the individual income tax filing base, corporate income tax total wages, and social security contribution base. While such discrepancies are not inherently non-compliant, they must be supported by a reasonable explanation and documented trail.第三,Include social security compliance in your monthly financial and tax review checklist, rather than waiting until year-end reconciliation or audit notifications to catch up.
